A spate of recent AI-generated videos has created a flutter online, where the faces of celebrities have been superimposed on the face of others to create viral content. While the makers themselves have clarified that these videos are essentially re-imaginings made for 'entertainment purposes', many have been left wondering if such videos can be called deepfake and constitute a form of identity theft, even if there was no malicious intent in their making. We look at the ethical and legal spaces where these videos exist.The term ‘deepfake’ is a combination of ‘deep’, which refers to the deep learning tools of AI, and ‘fake’, since they simulate reality. Going by this definition, all images or videos created using AI can be termed deepfake. However, people generally refer to face-swapping and voice cloning when they talk about deepfake, and whether the creator explicitly states it as AI-generated or not, this sort of content can be termed deepfake, says Divyendra Singh Jadoun, AI expert, who operates an A.I. start-up.
